Violencia sexual y acoso en la web: evidenciando la falta de tutela judicial efectiva

Abstract

Desde un análisis exploratorio, la presente investigación buscó conocer la justiciabilidad de la violencia sexual hacia las mujeres en la web, estudiando el diseño institucional administrativo, legislativo y judicial chileno que influye en la accesibilidad a la justicia y en las garantías efectivas para las víctimas. El texto comienza evidenciando cómo el espacio web resulta un ambiente propicio para la profundización de las desigualdades y violencias que sufren las mujeres en el mundo offline con resultados vulneratorios para sus derechos fundamentales. Luego se estudió el sistema legal y las alternativas que podrían tomar las afectadas para finalizar proponiendo una vía de acción judicial conducente a frenar los efectos de la difusión no consentida de material audiovisual que se refiera a las afectadas.  Taking an exploratory analysis as base, this research intended to learn about the justiciability of sexual violence against women online by studying the Chilean judiciary, legislative and administrative institutional design as it influences the Access to justice and the effective guarantee for victims. The text starts by showing evidence on how the web represents a favorable environment for the offline world with breaching results for their fundamental rights. Then, the legal system was studied as well as the alternatives that those affected could take. It ends by proposing a judicial action route that would lead to put a halt on the effects of the distribution of audiovisual material without the consent from the women involved.
