Abstract
The crime of violence or demolition is a crime that causes unrest in the community. Violence or demolition often occurs only because of a small problem, such as misunderstanding, intersecting when on the street, or provoked by other people's words. Violent crimes or demolition often result in injuries, both minor injuries and serious injuries, and can even cause death. The demand to provide punishment or a severe deterrent effect from the public against the holders of law enforcement power continues to be echoed. The existence of severe punishments is expected to reduce the crime rate that occurs in Indonesia. In legal arrangements for the crime of demolition based on decision number: 106/Pid.B/2021/PN. Ngw, the crime of demolition is regulated in article 170 of the Criminal Code with a criminal threat of a maximum of 5 (five) years and 6 (six) months. Berdasarkan putusan nomor: 106/Pid.B/2021/PN. Ngw terdakwa Defa Afriyantomy secara sah telah melakukan tindak pidana pengeroyokan dengan unsur-unsur: barang siapa, secara terang-terangan dan tenaga bersama melakukan kekerasan, dan terhadap orang atau barang dan dituntut dengan hukuman penjara selama 7 (tujuh) bulan.
