Abstract

This research aimed to provide response to the polemics and controversy over the Constitutional Court decision on the minimum age limit for presidential and vice-presidential candidates. Presently, the decision failed to preserve the dignity of the judicial institution, which should be free from conflicts of interest and external influence. In addition, this normative legal research adopted conceptual, statutory, and case methods. The result showed that the decision of the constitutional court regarding the minimum age for both presidential and vice presidential candidates was based on conflicts of interest, and decision read at an inappropriate time, without external supervision. These three factors were responsible for the Constitutional Court inability to maintain independence and integrity, leading to the decrease in the level of public trust.
