Materialismo e materialidade do direito / Materialism and the Materiality of Law

Abstract

Como conciliar a tarefa de uma sociologia critica do direito fazendo justica a autonomia do fenomeno juridico? Este artigo testa uma possivel resposta a essa pergunta. Argumenta-se que a visao marxista tradicional implica uma reducao do fenomeno juridico ao limitar-se a uma critica externa do direito. Embora correta, essa critica nao expande os horizontes teoricos da sociologia do direito. Apos recuperar a formulacao original de Marx para o binomio base/superestrutura (secao 2), tres versoes da sociologia marxista do direito sao rapidamente apresentadas (Lassalle, Paschukanis e Bourdieu--secao 3). Na sequencia, materialismo e materialidade sao confrontados (secao 4), para sustentar a passagem a uma perspectiva mais proxima da vida real dos tribunais, a etnografia juridica de Bruno Latour (secao 5). Embora Latour nao se encaixe no rotulo marxista, ele permite uma renovacao do vies critico da sociologia do direito. How to combine the tasks of a critical sociology of law and do justice to the autonomy of the legal phenomenon? This paper risks an answer to this question. It argues that the traditional Marxist view implies a reduction of the legal phenomenon, for it restrains itself to an external critical of law. Though correct, this view does not expand the theoretical horizon of the sociology of law. After recovering Marx's original formulation of the schema basis/superstructure (section 2), I briefly discuss three versions of Marxist sociology of law, namely Lassalle, Paschukanis and Bourdieu (section 3). Following that, the perspectives of materialism and materiality are confronted (section 4), in order to pave the way to the discussion of Bruno Latour's legal ethnography, an approach that seems to be closer to the real life of courts and legal praxis. Although Latour cannot be described as a Marxist, his theory enables a conceptual renewal of the critical sociology of law.
