EL RÉGIMEN PATRIMONIAL DE COMUNIDAD DE BIENES EN EL ACUERDO DE UNIÓN CIVIL.

Abstract

La comunidad de bienes es uno de los regímenes patrimoniales que contempla la Ley Nº 20830 que crea el Acuerdo de Unión Civil. Este es, de hecho, el más utilizado por las parejas que deciden celebrar dicho contrato. El objetivo de esta investigación es realizar un análisis crítico sobre la comunidad de bienes, su creación, administración y terminación. Para ello, se realiza un análisis eminentemente conceptual y comparativo. Además, se han introducido elementos sociológicos que permiten observar la influencia de la relación sustantiva de los convivientes civiles, en el diseño normativo de la comunidad de bienes. Con base en lo anterior, dicho régimen se caracteriza como uno excesivamente rígido, individualista y patrimonialista. Para corregir sus deficiencias, se propone orientar su enfoque hacia un modelo de “familia-comunidad”, que organice el acervo en torno a los fines de la familia.The joint-ownership is one of the property regimes contemplated by Law No. 20.830, that creates the Civil Union Agreement. This is, in fact, the most used by couples who decide to enter into such contract. The objective of this research is to make a critical analysis of the joint-ownership, its creation, administration and termination. For this purpose, an eminently conceptual and comparative analysis is carried out. In addition, sociological elements have been introduced to observe the influence of the substantive relationship of the civil partners, in the normative design of the joint-ownership regime. Based on the above, this regime is characterized as excessively rigid, individualistic and patrimonialist. In order to correct its deficiencies, it is proposed to orient its scope towards a “family-community” model, that organizes the assets around the purposes of the family.
