Ética de la Inteligencia Artificial jurídica aplicada al proceso

Abstract

En este trabajo se proponen una serie de principios éticos reguladores de la Inteligencia Artificial Jurídica aplicada al proceso judicial. Se comenzará con una introducción de la coyuntura social y tecnológica del momento. Tras ello, se hablará brevemente de los retos que plantea la Inteligencia Artificial Jurídica. El punto 3 se destinará a resumir el enfoque ético europeo respecto a esta tecnología, pasando luego a proponer siete principios ético-jurídicos que habrán de guiar el desarrollo de la Inteligencia Artificial Jurídica aplicada al proceso. En último lugar, se incidirá en la necesidad de un desarrollo legislativo de estos principios.In this paper, a framework of regulatory ethical principles of Legal Artificial Intelligence applied to the judicial process is proposed. It will begin with an introduction to the current social and technological situation. The challenges posed by Legal Artificial Intelligence will be then briefly discussed. A summary of the European ethical approach to this technology will follow. Next paragraph will refer to the seven ethical-legal principles that should guide the development of Legal Artificial Intelligence applied to judicial process. Finally, the need for a legislative development of these principles will be pointed.
