Abstract
In the present work we will investigate whether or not it is effective that the evidentiary conventions in the Chilean criminal process not only exempt from proof the factual data on which they fall, but that they can be agreed with no requirement of the requirements that the right to presumption of innocence imposes the evidence of guilt.
