Communicational barriers in the practice of surrogacy. A crisis in times of pandemic

Abstract

The implementation of surrogacy has given raise to intense bioethical and legal debate around the world due to the difficult conflicts that reveal the complexity of this issue. The purpose of this paper is to answer which are the communicational barriers that emerge in the biomedical practice of surrogacy in ordinary and pandemic times, to understand the bioethical and legal implications in the light of the universal principle of human dignity and the need to resolve these barriers. For this purpose, a conceptual approach is presented, the characterization of the main problems and their respective legislative framework at the international level. Subsequently, the external and internal communicational barriers of the bio-reproductive ecosystem of surrogacy are identified, with a special analysis of the situation in times of pandemic. Finally, the discussion is presented within the framework of the bioethical principle and human right of human dignity, in order to confirm the thesis that explains how communicational barriers affect the dignity of the people involved in this practice.
