Abstract

Development during the Industrialization era resulted in limited land for the community and resulted in conflict in the process of obtaining land rights. The conflict that ocurred, namely the occupation of Forest Areas resulting in the issuance of certificates of land rights over forest areas. The purpose of the paper are to examine and analyze the legal status of land rights issued over forest areas. The research method used by the researcher is normative law research. The result of the research is that the legal position of land title certificates is as a means of proof for rights holders and to ensure the creation of legal certainty in society. Regarding the legal status of the land title certificate in the Bayat Forest Zone dispute case, it must be canceled because in this case the judicial process has proven that the certificate issuance process is above the forest area.
