Temporary educational right and remote education in higher education during the pandemic of coronavirus: The emergence of digital transformation

Abstract

The coronavirus pandemic brought the unpredictability of the educational right in person, considering that social isolation measures are an emergency instrument to contain the curves of contamination and spread of the virus and prevent the collapse of the Brazilian health system. It is verified that the right to high school education is also a fundamental right provided for in the Constitution of the Republic of 1988. Under this aegis, the present study seeks to verify how to realize the fundamental right to higher education during the Covid-19 pandemic. It is important to record that due to the confrontation between the fundamental right to health and the fundamental right to education, it is necessary to safeguard the right to life and health, and the restrictions imposed on the educational right are necessary. Due to this unforeseen event, face-To-face higher education had to be readapted through emergency and temporary remote education, to ensure the exercise of the right to education safely for the population. For this aspect, the present study aims to analyze the viability of remote education in higher education, through the use of digital technology in teaching. To this end, the research will make a documental analysis of the statistical data of the coronavirus pandemic in the country. In addition, the theoretical incursion will use a critical-reflexive approach and will take the examination of official documents on higher education and the temporary and emergency resolutions of remote education, as well as the analysis of doctrinal works dealing with fundamental rights and technological education, through a reflexive and interdisciplinary approach.
