Abstract

This paper wants to establish whether the courts of justice, when deciding the applicable law, may declare a pre-constitutional legal precept derogate for contravening the Constitution, directly applying it as a legal rule with derogating effects. Or, only the Constitutional Court can verify the conformity of the law with the Constitution, through the action of inapplicability or the action of unconstitutionality. The above, analyzing the criteria of the Supreme Court and the Constitutional Court.
