Abstract
Brand registration is a crucial aspect of running a product for business advantage. It is very important that the parties will fight over the brand even though there are many other brands that can be used because the brand serves as the business image. In Indonesia, trademark registration and legal protection of counterfeit marks are regulated in Law Number 20 of 2016 on Marks and Geographical Indications. This is a normative legal research, which the study concludes that the laws and regulations that have been enacted are deemed sufficient to provide legal protection against trademark disputes that may arise. However, the problem lies in the subject matter, namely the operator who examines the application for registration of the mark and the applicant for the mark.
