Abstract

This work aims to defend the inclusion of the gender perspective as a tool that favors the legal protection of rights for women and lgbtiq+ people. We uphold the idea that the access to justice must be understood as an essential human right in a democratic state. So, it is relevant to remove obstacles affecting these categories of people in line with the international human rights standards. In this context, based on the Chilean case, we endorse the idea
