Um Tribunal Constitucional Internacional para garantir os direitos democráticos e os Direitos Humanos

Abstract

Resumo O artigo apresenta a defesa do Projeto do Tribunal Constitucional Internacional como mecanismo de garantia dos Direitos Internacionais e das Liberdades Democráticas na comunidade internacional. Por meio de estudos de casos, análise comparada de constituições, tratados, convenções e estatutos internacionais, assim como a atuação de órgãos internacionais, como do Tribunal Internacional de Haia e, principalmente, do Tribunal Internacional Penal, o texto demonstra as fragilidades e lacunas existentes que podem ser mediadas e suprimidas com um novo órgão de jurisdição internacional, capaz de fortalecer os órgãos já existentes e alcançar demandas ainda não atingidas. As principais críticas aos órgãos judiciais internacionais e conceitos como soberania e imunidade são abordados para questionar a fragilidade da resistência a este projeto.Abstract Through practical case studies, the comparative analysis of international constitutions, treaties, conventions, experiences and practices, as well as studies by international institutions, such as the International Court of the Hague, and the Criminal Court, in particular, demonstrates the existing weaknesses and gaps that can be remedied and eliminated with a new international legal institution, that has to be capable of strengthening already existing institutions and achieving the unfulfilled requirements. The main international legal criticisms of institutions and concepts, such as sovereignty and immunity, are raised to question the fragility of resistance to this project.
