A justiça das transições: uma proposta de análise para Portugal, Espanha, Argentina e Brasil

Abstract

Resumo: Este estudo analisa diferentes trajetórias no que se refere ao julgamento de violações aos direitos humanos praticadas na vigência de regimes de exceção em quatro países: Portugal, Espanha, Argentina e Brasil. O objetivo geral da pesquisa é identificar elementos que ajudem a entender por qual razão países que passaram por transições à democracia semelhantes estabeleceram estratégias jurídicas diferentes no que tange ao julgamento e à punição dos crimes cometidos pelos regimes autoritários. Trata-se de um estudo realizado com método qualitativo, baseado em pesquisa documental, bibliográfica e bases de dados, que realiza uma primeira comparação dos quatro casos. Com base nos estudos transitológicos, formulou-se a hipótese que guia a pesquisa. A hipótese sugere que países que passaram por transições por ruptura possuem maiores chances de punir os crimes cometidos por uma ditadura, enquanto países que passaram por transições negociadas possuem maiores dificuldades de fazê-lo. Os dados compilados e analisados no artigo demonstram que a hipótese é parcialmente correta, uma vez que o tipo de transição, isoladamente, não determina o padrão de judicialização dos crimes das ditaduras nos países selecionados para o estudo.Abstract: This study analyzes different pathways through which Portugal, Spain, Argentina and Brazil with regard to the prosecution of human rights violations committed under exceptional regimes in four countries. The general objective of the research is to identify elements that help to understand why countries that have gone through similar transitions to democracy have established different legal strategies regarding the judgment and punishment of crimes committed by authoritarian regimes. This is a study carried out with a qualitative method, based on documental, bibliographic and database research, which performs a first comparison of the four cases. Based on the transitological studies, the hypothesis that guides the research was formulated. The hypothesis suggests that countries that have gone through transitions by rupture are more likely to punish crimes committed by a dictatorship, while countries that have gone through negotiated transitions have greater difficulties in doing so. The data compiled and analyzed in the article demonstrate that the hypothesis is partially correct, since the type of transition, in isolation, does not determine the pattern of judicialization of crimes committed by dictatorships in the countries selected for the study.
