Abstract

Una vez que se verifica la tipicidad de la conducta: imputación objetiva e imputación subjetiva, el siguiente escalón a analizar, dentro de la teoría del delito, es la antijuridicidad de la conducta. En esta se verifica si la conducta desplegada por el autor va en contra de la normativa jurídico-penal. En tal sentido, lo interesante de la antijuridicidad es su aspecto negativo; es decir, la forma en la que se excluye la responsabilidad penal: mediante la legítima defensa y el estado de necesidad justificante. Al respecto existe un debate dogmático en atención a cómo se debería encuadrar la defensa realizada por una persona o por un tercero frente a la agresión de un sujeto inimputable y, además, cómo es que se debería llevar a cabo dicha defensa. A brindar más luces respecto a este interesante debate es que a lo que se aboca el presente artículo.Once the typicality of the conduct is verified: objective imputation and subjective imputation, the next step to analyze, within the theory of crime, is the illegality of the conduct. In this, it will be verified if the conduct displayed by the author goes against the legal-criminal regulations. In this sense, what is interesting about illegality is its negative aspect; that is, the way in which criminal liability is excluded: through legitimate defense and the state of justifying necessity. In this regard, there is a dogmatic debate in attention to how the defense carried out by a person or a third party against the aggression of an unimputable subject should be framed and, in addition, how it is that said defense should be carried out. This article is dedicated to providing more light regarding this interesting debate.
