Problem Shopee Affiliates Program di Aplikasi Shopee: An Islamic Law Perspective

Abstract

This research aims to determine the Islamic law review of using the Shopee affiliate program and leader commissions obtained from Shopee affiliate program members in the Shopee application. The research method used is qualitative, with a type of field research using a normative approach that uses legal theories. Meanwhile, data collection techniques use observation, interviews, and documentation. The analytical method used in this research is the inductive method. The results of this research can conclude that 1) The use of the Shopee Affiliates program is far from MLM business, which is not permitted. In contrast, in the Shopee Affiliates program, there is precise work and an element of hard work to get wages or commissions, which is relevant to the job requirements at Rukun Ju. 'ālah. Using the Shopee Affiliates program fulfills the terms and conditions of the ju'ālah agreement. 2) The leader's commission from the member commission is valid if viewed from the ju'ālah contract in Islamic law because the leader has completed his work. This is following the wage requirements in the pillars of ju'ālah. Penelitian ini bertujuan untuk mengetahui tinjauan hukum Islam terhadap penggunaan shopee affiliates program dan komisi leader yang didapatkan dari member shopee affiliate program di aplikasi shopee. Metode penelitian yang digunakan adalah kualitatif dengan jenis penelitian lapangan (field research) melalui pendekatan normatif, yang mana menggunakan teori-teori hukum didalamnya. Sedangkan teknik pengumpulan data dengan menggunakan observasi, wawancara, dan dokumentasi. Metode analisis yang digunakan dalam penelitian ini adalah metode induktif. Hasil penelitian ini dapat disimpulkan bahwa 1) Penggunaan shopee affiliates program ini jauh dari bisnis MLM yang tidak diperbolehkan, dimana dalam shopee affiliates program ada pekerjaan yang jelas serta ada unsur jerih payahnya untuk mendapatkan upah atau komisi dan hal tersebut relevan dengan syarat pekerjaan di rukun ju’ālah. Penggunaan shopee affiliates program ini sudah memenuhi rukun dan syarat dari akad ju’ālah. 2) Komisi yang didapatkan leader dari komisi member adalah sah jika ditinjau dari akad ju’ālah dalam hukum Islam, karena leader sudah menyelesaikan pekerjaannya. Hal tersebut sudah sesuai dengan syarat upah pada rukun ju’ālah.
