Abstract

This article discusses the criminalization of female adultery by presenting some questions on the conceptual debate around the term 'patriarchy', especially those debated by Engels and Marxist female authors of the 20th century. The Roman patriarchal context of the Augustan period is discussed to point out historical specificities of different realities that dialogue. In this sense, elements of Roman Law and Brazilian Criminal Law are analysed for a brief discussion on violence against women and feminicide.
