Pengawasan Terhadap Netralitas Aparatur Sipil Negara Dalam Pemilihan Kepala Daerah (Studi Di Kantor Badan Kepegawaian Daerah Kabupaten Asahan)

Abstract

ABSTRAKPemilihan Kepala Daerah yaitu tidak netralnya Aparatur Sipil Negara terhadap Pemilihan Kepala Daerah yang berlangsung dan tidak sedikit membuat netralitas Aparatur Sipil Negara dalam pemilihan kepala daerah ini menjadi faktor utama berbagai kecurangan. Netralitas Aparatur Sipil Negara memang sangat dibutuhkan dalam proses politik seperti Pemilihan Kepala Daerah karena Aparatur Sipil Negara merupakan selaku pelayan publik dan pegawai Aparatur Sipil Negara yang betul-betul berdiri secara independen tanpa harus memihak. Pada penelitian hukum ini menggunakan metode penelitian hukum empiris dan melakukan studi ke di Kantor Badan Kepegawaian Daerah Kabupaten Asahan. Pada penelitian hukum ini menggunakan bahan hukum primer, yaitu : Peraturan Perundang-Undangan. Bahan hukum sekunder, yaitu : buku-buku hukum. Bahan hukum tersier, yaitu : buku-buku non hukum. Pada dasarnya dalam pelaksanaan pengawasan atas terjadinya suatu ketidaknetralan oknum Aparatur Sipil Negara (ASN) Kabupaten Asahan, maka tindakan Badan Kepegawaian Daerah melakukan kajian terhadap laporan atau temuan dugaan pelanggaran netralitas Aparatur Sipil Negara (ASN) Kabupaten Asahan untuk memastikan apakah hal tersebut benar mengandung pelanggaran ataupun tidak. Dan selanjutnya hasil pemeriksaan oleh Badan Kepegawaian Daerah (BKD) Kabupaten Asahan, yang mana apabila Aparatur Sipil Negara (ASN) Kabupaten Asahan terlibat dalam masalah ketidaknetralan dalam Pemilihan Kepala Daerah di Kabupaten Asahan, maka Badan Kepegawaian Daerah (BKD) Kabupaten Asahan akan memberikan suatu sanksi adminitrasi yang dalam hal ini dapat berupa penurunan pangkat ataupun penundaan kenaikan pangkat ataupun pula adanya pemecatan terhadap oknum Aparatur Sipil Negara (ASN) Kabupaten Asahan. Kata Kunci    :   Pengawasan, Pemilihan Kepala Daerah, Netralitas. ABSTRACTThe Regional Head Election, namely the non-neutrality of the State Civil Apparatus towards the Regional Head Election that took place and not least made the neutrality of the State Civil Apparatus in this regional head election a major factor in various frauds.
