Aproximaciones al concepto de reparación: perspectivas jurídica y filosófico-política

Abstract

A lo largo de la historia de las interacciones sociales se ha presentado lafigura del daño como aquello que se hace en contra del otro y puede vulnerarsu integridad física, patrimonial o emocional, convirtiendo a ese otroen víctima de un perjuicio.La reparación a las víctimas ha estado supeditada a una serie de evolucioneshistóricas y a la vez a la emergencia de disciplinas académicas que sehan preocupado por conceptualizar este problema, evaluando sus alcances,límites, dificultades y controversias.Este artículo pretende analizar las perspectivas que han sido protagonistasen la emergencia del concepto de reparación a las víctimas, centrándose endos enfoques, uno jurídico abordado a partir de la teoría de la responsabilidadcivil extracontractual y otro filosófico-político fundamentado en la teoría delos derechos humanos y la teoría de la justicia, teniendo en cuenta los análisispropios de la justicia transicional y la justicia restaurativa.Through the history of social interactions, the figure of harm has been presentedas something performed against other person and can infringe thephysical, patrimonial and emotional integrity, turning him or her into anothervictim of a prejudice. The repair to the victims has been subordinated toa series of historical evolutions as well as the appearance of academicdisciplines that have concerned in conceptualizing this problem, testingtheir reaches, limits, difficulties, and controversies. This article pretendsto analyze the perspectives that have been protagonist in the appearanceof the concept of repair to the victims, focusing in two approaches, one ofthem is juridical and is studied from the theory of the extracontractual civilresponsibility, and the other of them is philosophical-political based on thetheory of human rights and the theory of justice, taking into account theanalysis from the transitional justice and the restorative justice.
