The Implementation of Land Registration to Provide Legal Certainty in Indonesia

Abstract

Objective: This research examines the implementation of land registration in Indonesia to provide legal certainty over land ownership. This research aims to analyze the factors that influence the land registration process and its impact on legal protection for landowners.   Theoretical Framework: This research is well grounded in the principles of agrarian law, including Law No. 5/1960 on Basic Agrarian Principles and other relevant regulations. The main theories used include legal certainty, administrative efficiency, and protection of land rights, which form the basis for understanding the challenges and implications of land registration.   Method: This research took a qualitative approach with a case study method. Data were collected through in-depth interviews with National Land Agency officers, landowners, and agrarian law experts, as well as document analysis. Data were analyzed using thematic methods to identify relevant patterns and relationships.   Results and Discussion: There exists significant obstacles in the land registration process, such as low public awareness, complex bureaucracy, and often occurring land disputes due to overlapping claims. This paper contextualizes these challenges within a legal framework, emphasizing the importance of public education, simplifying procedures, and strengthening enforcement mechanisms. Limitations such as data access and procedural inefficiencies are also discussed.   Research Implications: The research offers both practical and theoretical insights, while highlighting the need for better land administration systems, more active community engagement and a strong regulatory framework. These recommendations are intended to improve legal certainty and reduce land-related conflicts, benefiting sectors such as real estate and rural development.   Originality/Value: This research contributes to the literature by providing a deeper comprehension of the complexities of land registration in Indonesia. Its value resides in the practical solutions offered for policymakers and stakeholders to improve the effectiveness and fairness of the land registration system, as well as promoting social and the economic stability.
