La educación como derecho constitucional y servicio público

Abstract

Este artículo describe la regulación del derecho a la educación en la legislación peruana. En primer lugar, analiza la relación entre educación y derecho. La educación es un término metalegal; la ley solo garantiza formalidades en torno a la educación, excepcionalmente, algún principio metajurídico sobre la educación. Luego, el autor describe la educación como una relación. Finalmente, determina las relaciones educativas protegidas en el Perú: padres-hijos, educación pública y educación religiosa.This article examines the regulation of the right to education within Peruvian legislation. First, it analyzes the relationship between education and law. Education is a metalegal concept; the law only guarantees the formal aspects surrounding education and, in exceptional cases, certain meta-juridical principles related to it. The author then describes education as a relational construct. Finally, the article identifies the educational relationships protected in Peru: parent–child relations, public education, and religious education.
