Abstract
This paper attempts a postpositive approach to the practice of judicial activism in the adjudication of benefits based on social rights and, in general, on fundamental rights. Centrally, a set of four alternative scenarios where such adjudication would operate is sketched, which can serve itself as a tool for the critical examination of judicial activism in specific cases.
