قاعدة درء المفاسد مقدم على جلب المصالح وأثرها في النوازل الطبية المعاصرة

Abstract

تهدف هذه الدراسة إلى بيان الدور البارز للقواعد الفقهية في الاجتهاد الفقهي، وذلك من خلال التعرض لقاعدة درء المفاسد مقدم على جلب المصالح وبيان أثرها في التوصل لأحكام النوازل الطبية، فتعرضت لبيان القاعدة إفرادا وتركيبا وتوثيقا، ثم عرجت على بعض تطبيقاتها في النوازل الطبية، وقد استندت في كل ذلك على المنهج الوصفي والحواري والتحليلي، فتوصلت لمجموعة نتائج منها أن التقعيد الأصولي أو الفقهي له دور كبير في تنمية الملكات وترسيخها لدى الباحثين في العلوم الشرعية، فالقواعد تعين على جمع المتفرقات وضبط المتشابهات وحسن الاستنباط والتنزيل، كما توصلت لمدى قدرة هذه القاعدة على توجيه النوازل الطبية التي تتعارض فيها المصالح مع المفاسد، ومدى احتياج الفقيه لها، لأنها تُصَير اجتهاداته اجتهادات رصينة، مبنية على قواعد دقيقة، بها يكون النظر سديدا، والتنزيل رشيداً.This study aims to demonstrate the prominent role of jurisprudential rules in jurisprudential jurisprudence, through exposure to the rule of warding off harm takes precedence over bringing benefits and showing its impact in reaching the provisions of medical emergencies, I was exposed to the statement of the rule individually, composition and documentation, then I showed some of its applications in medical emergencies, It was based on the descriptive dialogical and analytical approach in all of this, So I reached a set of results, including that jurisprudence or jurisprudence has a great role in developing and consolidating the faculties of researchers in the legal sciences. And the extent to which the jurist needs it, because it becomes his jurisprudence sober, based on precise rules, with which the consideration is correct, and the download is rational.
