Relación cronológica entre la ley y la realidad social. Mención particular sobre la "elasticidad de la ley"

Abstract

This paper aims is presented as an essay and an initial investigation. Part of the science of law has referred to the problem when the law is lagging behind, in connection with the social reality that is changing over time. Eduardo Novoa Monreal is the chilean jurist who been exposed these problems in a better way direct and systematics. Taking as a starting point this basis, it is proposed to analyze the capacity of the law to the adaptation of to the variations and / or social changes. To this capacity of the law, we refer with the name "elasticity", as opposed to the breaking elasticity, which we called as "legal obsolescence". Three normative factors and two social factors involved in evaluating this elasticity are proposed.
