Abstract

Eliminating Conflicts of Interests: Greater Transparency or Generalized Mistrust? The most recent private and public sphere scandals (Cahuzac, Woerth, Mediator) that have dominated the headlines have revealed the gradual and insidious inset of a society of mistrust. One of the main causes of this mistrust towards political, juridical or economical decision-makers is to be found in the existence of numerous illegitimate conflicts of interests. Both private and public laws are now trying to impose greater transparency in order to restore the trust that is essential to the development of a society and a state of law. However, in order to fight bad conflicts of interests efficiently, one must choose the appropriate weapons. Otherwise, the remedy might be worse than the disease. © Le Seuil.
