Relevance of the Application of the Concept of Syibhul Iddah for Men from the Perspective of Maqasid al-Shari'ah and Qawaid Fiqhiyyah

Abstract

The purpose of this study is to reveal the relevance of the application of the concept of Syibhul Iddah for men from the perspective of Maqasid Al-Syari'ah and Qawaid Fiqhiyyah. This study is a qualitative study, the type of research is library research. The type of research is descriptive qualitative research. The data collection method used is literature study. With a multidisciplinary approach. This study uses a qualitative method that is arranged in a descriptive, comparative and analytical manner. The results of the study show that; the concept of syibhul iddah for men is present as a solution to minimize the harm that may arise due to divorce. This syibhul iddah provides a waiting period for men to calm down and reconsider their decision to divorce. Although men are not required to undergo the iddah period like women, in some situations, the application of syibhul iddah can provide greater benefits. For example, syibhul iddah can prevent hasty reconciliation and potentially cause the same problems in the future.
