Abstract

Este artículo analiza el trabajo infantil en Colombia desde una perspectiva normativa y su erradicación, sin dejar de lado el impacto que tiene en el desarrollo y bienestar de niños, niñas y adolescentes. Para ello, se examina la normativa nacional, incluyendo la Constitución Política de Colombia, el Código de Infancia y Adolescencia y la jurisprudencia relevante. Asimismo, se considera el marco normativo internacional, con regulaciones establecidas por organismos como la Organización Internacional del Trabajo (OIT), la cual establece que la edad mínima para que un menor de edad pueda trabajar es de 15 años, según el Convenio 138 (Organización Internacional del Trabajo, 1973). A pesar del marco normativo vigente que busca erradicar esta problemática, la explotación laboral infantil sigue siendo una realidad, especialmente en contextos de pobreza y vulnerabilidad. No obstante, se destaca el esfuerzo de entidades como el Ministerio del Trabajo y la UNESCO en la lucha contra el trabajo infantil y en la protección de los derechos fundamentales de la niñez.This article analyzes child labor in Colombia from a regulatory perspective and its eradication, without neglecting its impact on the development and well-being of children and adolescents. To this end, it examines national regulations, including the Colombian Political Constitution, the Code of Childhood and Adolescence, and relevant jurisprudence. It also considers the international regulatory framework, with regulations established by organizations such as the International Labor Organization (ILO), which establishes that the minimum age for minors to work is 15, according to Convention 138 (International Labor Organization, 1973). Despite the current regulatory framework that seeks to eradicate this problem, child labor exploitation remains a reality, especially in contexts of poverty and vulnerability. However, the efforts of entities such as the Ministry of Labor and UNESCO in the fight against child labor and the protection of children's fundamental rights are highlighted.
