Abstract
Nos últimos anos a biotecnologia tem avançado e o cérebro, cada vez mais, está sendo conectado diretamente a computadores, resultando na coleta e compartilhamento de dados cerebrais, que são muito sensíveis, por se tratar de pensamentos e emoções inconscientes. À vista do exposto, novos direitos estão sendo estudados com o fim de evitar o hacking do cérebro, assim sendo, fala-se dos neurodireitos. Portanto, o objetivo deste estudo é, por meio de abordagem dedutiva, investigar, de forma qualitativa, através de revisão bibliográfica, o direito à neuroproteção. O problema é saber o que são os neurodireitos? Como resultados, há evidências que os avanços da neurotecnologia trazem riscos à mente e ao cérebro dos indivíduos que fazem uso da ferramenta, no que diz respeito à privacidade dos dados, à integridade física e mental, identidade, continuidade psicológica e ao seu acesso e, que os quais devem ser neutralizados por meio de normas que regulamentem os seus usos e limites sob perspectiva ética. A neurotecnologia permite o acesso, a coleta, o compartilhamento e a manipulação dos dados do cérebro humano, o que ameaça a autonomia e a personalidade humana. Respondendo ao problema de pesquisa, fica evidenciado que os neurodireitos são uma nova classe de direitos humanos de personalidade que almeja regular o uso e o desenvolvimento de novas tecnologias relacionadas ao cérebro. De início, é importante destacar que os neurodireitos não têm como sujeitos apenas os usuários, mas também os especialistas dedicados a eles, devendo, portanto, respeitar os seus direitos humanos fundamentais. Nesse contexto, cinco novos direitos humanos relacionados à personalidade são propostos para que se proteja o cérebro humano: identidade pessoal, livre arbítrio, privacidade mental, igualdade de acesso a neuro-aprimoramento e proteção contra vieses algorítmicos de inteligência artificial (IA). Concluindo, presume-se que o Brasil necessita incentivar reflexões sobre os desafios que a neurotecnologia e a inteligência artificial representam para os direitos humanos e para a dignidade humana.In recent years, biotechnology has advanced and the brain is increasingly being connected directly to computers, resulting in the collection and sharing of brain data, which are very sensitive, as they are unconscious thoughts and emotions. In view of the above, new rights are being studied, in order to avoid hacking the brain, therefore, we are talking about neurorights. Therefore, the objective of this study is, through a deductive approach, to investigate, in a qualitative way, through a bibliographical review, the right to neuroprotection. The problem is to know what neurorights are? As a result, there is evidence that advances in neurotechnology bring risks to the mind and brain of individuals who use the tool, with regard to data privacy, physical and mental integrity, identity, psychological continuity and their access and , which must be neutralized by means of norms that regulate their uses and limits from an ethical perspective. Neurotechnology allows access, collection, sharing and manipulation of human brain data, which threatens human autonomy and personality. Responding to the research problem, it is evident that neurorights are a new class of human rights of personality that aims to regulate the use and development of new technologies related to the brain. At the outset, it is important to highlight that neurorights are not only subject to users, but also specialists dedicated to them, and must therefore respect fundamental human rights. In this context, five new human rights related to personality are proposed to protect the human brain: personal identity, free will, mental privacy, equal access to neuro-enhancement and protection against algorithmic biases of artificial intelligence (AI). In conclusion, we assume that Brazil needs to encourage reflections on the challenges that neurotechnology and artificial intelligence represent for human rights and human dignity.
