Moldura institucional e projetos de institucionalização do regime militar brasileiro (1964-1978)

Abstract

A ditadura militar consolidou moldura institucional que consistia na convivência de constituições (primeiro a de 1946, depois a de 1967) com legislação excepcional, especialmente os atos institucionais. Tal convivência não expressava uma contradição, tendo sido eficaz para a imposição das chamadas “punições revolucionárias”, ao mesmo tempo que possibilitou aos sucessivos governos militares a busca de um padrão de institucionalização que tinha como fundamento a inclusão em nova constituição de mecanismos de segurança do Estado que realizassem o projeto autoritário de uma “democracia forte”. A convivência entre constituição e legislação excepcional durante a ditadura militar foi possível como decorrência da tradição de intervencionismo militar na história republicana brasileira. O Superior Tribunal Militar (STM), a partir do momento em que passou a julgar civis acusados de crimes políticos, debateu a peculiar moldura institucional da ditadura militar.The Brazilian military dictatorship established an institutional framework characterized by the coexistence of the 1946 and 1967 constitutions with institutional acts. The coexistence of constitutions with institutional acts was not a contradiction. This coexistence was effective not only for the application of “revolutionary punishments”, but also for the attempt to “institutionalize” the dictatorship. Institutionalization presupposed the imposition of a new constitution that would give birth the authoritarian project of a “strong democracy”. The coexistence of the constitutions with exceptional legislation was possible because of the tradition of military interventionism in Brazilian republican history. The Superior Military Court (STM), since it started the political trials of civilians accused of political crimes, has debated the peculiar institutional framework of the military dictatorship. The aim of this article is to discuss the peculiarity of the institutional framework and institutionalization of the Brazilian military dictatorship – in light of the long tradition of interventionism by the military in the country's domestic policy – in the period of its consolidation (1964-1978).
