Abstract

The paper presents a conceptualization model of terrorism as criminalization category, the implementation of which should lead to its legislative definition in the (exclusive) shape of an "organization offense". Hereto, the paper first develops a function characterization of terrorism as a strategy of political communication, which grounds upon the recourse to violence against physical persons as its distinctive tactic. Then, a general reconstruction of the structure of so called "unlawful association offenses" as organization offenses is offered, which enables, in the last section, the spelling out the specific wrongfulness content of a terrorist organization offense, by means of a triadic articulation of that same content.
