Objeciones a la paz colombiana: derecho y realidad en 2019

Abstract

El objetivo es analizar el proceso de aprobación de la ley estatutaria de la Jurisdicción Especial para la Paz desde la finalización del Acuerdo del Colón, firmado con el Gobierno de Juan Manuel Santos Calderón, hasta las objeciones realizadas por el nuevo gobierno de Iván Duque. El planteamiento del problema se propone responder si la decisión de objetar la ley en mención, pone en riesgo la construcción de la paz, en Colombia. El método para resolver el cuestionamiento, se apotará en tipo de investigación analítica que recogerá datos procedentes de fuentes primarias y secundarias, a través de minería electrónica, dentro del recorte temporal 2016-2019, y siendo Colombia el recorte espacial. Se arrojan resultados relativos a los impactos jurídicos y políticos que genera la objeción en la realidad endógena y exógena de la Colombia en transición.The objective is to analyze the process of approval of the statute law of the Special Jurisdiction for Peace since the end of the Colón Agreement, signed with the Government of Juan Manuel Santos Calderón, up to the objections made by the new government of Iván Duque. The approach of the problem is to answer if the decision to object the law in question, puts at risk the construction of peace, in Colombia. The method to solve the questioning, will be apotará in type of analytical investigation that will gather data coming from primary and secondary sources, through electronic mining, within the temporary cut 2016-2019, and being Colombia the spatial cut. Results are shown regarding the legal and political impacts generated by the objection in the endogenous and exogenous reality of Colombia in transition.
