Regular o no regular: el caso Airbnb en Perú

Abstract

“Do not talk to strangers” became a very recurrent phrase in our childhood and youth. Nevertheless, how would our parents react if they found out that we have opened the doors of our homes to strangers? Since the arrival of Airbnb, there have been more questions than answers about its service; nevertheless, these uncertainties have gone unnoticed because thousands of users have seen their requirements more adequately fulfilled compared to the use of hotels, hostels, and inns. Consumers have taken full advantage of the service without the need to know its legal nature due to its practicality. However, despite the lack of knowledge on the subject, legislators have tried to regulate the service on several occasions and, without being aware of it, with these measures, they have denaturalized the law, the Airbnb service, and, as a consequence, the rise of the service on the market.“No le hables a extraños”, resultó ser una frase muy recurrente conforme se fue desarrollando nuestra niñez y juventud. Pero ¿cómo reaccionarían nuestros padres si se enteraran de que “les hemos abierto las puertas de nuestro domicilio a extraños”? Desde que llegó la compañía Airbnb, han existido más preguntas que respuestas sobre el servicio; no obstante, dichas incógnitas han pasado desapercibidas gracias a que miles de usuarios han visto satisfechas sus necesidades más acordemente en comparación con el uso de hoteles, hostales o posadas. Sin la necesidad de conocer la naturaleza jurídica del servicio, los consumidores le han sacado el máximo provecho, gracias a la practicidad de este. Sin embargo, pese al desconocimiento sobre la materia, algunos legisladores intentaron regular el servicio en diversas ocasiones y, sin percatarse, con dichas medidas propusieron desnaturalizar el derecho, el servicio de Airbnb y, como consecuencia, el auge del servicio en el mercado.
