QUO VADIS KEADILAN DI NEGRI INI Sebuah KERESAHAN MASYARAKAT DALAM BERHARAP KEPASTIAN & KEMANFAATAN HUKUM

Abstract

Penegakan hukum yang terjadi di masyarakat, terutama yang dialami oleh kelompok ekonomi rendah, sering kali memunculkan ketidakadilan. Masyarakat dengan ekonomi rendah merupakan kelompok sosial yang paling rentan terhadap perlakuan hukum yang tidak adil. Ketidakadilan ini muncul dari penerapan hukum dalam sistem yang ada. Ketika hukum dipisahkan dari konteks sosialnya, maka keadilan yang diharapkan oleh masyarakat akan sulit tercapai. Aparat penegak hukum sering kali hanya melihat dan memahami kasus-kasus yang melibatkan masyarakat golongan bawah melalui teks-teks (pasal kaku) yang tertera dalam undang-undang, bersikap legalistik dan positivistik, tanpa berusaha memahami situasi tersebut dalam konteks sosiologisnya. Oleh karena itu, penting untuk memberikan keberpihakan hukum kepada masyarakat bawah. Penegakan hukum yang bersifat afirmatif dan berpihak tidak cukup jika hanya dibangun melalui paradigma legalistik-positivistik; diperlukan juga pendekatan kritis dan progresif. Para pengadil tidak hanya dituntut untuk memiliki pemahaman dan keterampilan hukum yang mumpuni, tetapi juga dituntut untuk mengembangkan kreativitas serta terobosan hukum yang positif. Hal ini sangat penting untuk menciptakan keadilan serta manfaat hukum yang lebih luas bagi Masyarakat sesuai dengan amanat undang-undang dasar 1945 Pasal 28 D ayat (1) dan Alinea I Pembukaan UUD 1945.Law enforcement that occurs in society, especially those experienced by lower economic groups, often gives rise to injustice. Communities with low economic levels are the social groups most vulnerable to unfair legal treatment. This injustice arises from the application of law in the existing system. When law is separated from its social context, the justice expected by society will be difficult to achieve. Law enforcement officials often only see and understand cases involving the lower classes of society through the texts (rigid articles) contained in the law, taking a legalistic and positivistic attitude, without trying to understand the situation in its sociological context. Therefore, it is important to provide legal support to lower society. Affirmative and impartial law enforcement is not enough if it is only built through a legalistic-positivistic paradigm; a critical and progressive approach is also needed. Judges are not only required to have adequate legal understanding and skills, but are also required to develop creativity and positive legal breakthroughs. This is very important to create justice and broader legal benefits for society in accordance with the mandate of the 1945 Constitution, Article 28 D paragraph (1) and Paragraph I of the Preamble to the 1945 Constitution.
