Abstract
The Law Commission's proposals in Law Com. No. 305 in respect of liability for participation in joint criminal ventures are further examined in the light of the commencement ofPt2 of the Serious Crime Act 2007 and the decision of the House of Lords in Rahman. It is submitted that those proposals should not be implemented. The effect of the common law in the absence of statutory reform is then assessed. © 2009 THOMSON REUTERS (LEGAL) LIMITED.
