Abstract

Today, there are many cases involving flat or apartment developers who neglect the legal certainty in the implementation of housing and residential areas as stipulated in Article 3 letter a of Law Number 1 of 2011 on Housing and Residential Areas. One form is sales with pre-project selling. This practice is permitted by law by requiring the existence of a Purchase Agreement (PPJB) drawn up by and before a Notary. This practice is closely related to the authority of a Notary to be able to conduct legal counseling in connection with making a deed as stipulated in Article 15 paragraph (2) letter e of Law Number 2 of 2014 on Amendments to Law Number 30 of 2004 on the Notary Public. Therefore, a formulation of the problem is drawn, what is the role of a notary in legal counseling regarding the practice of buying and selling apartments through the pre project selling method? The research method used is normative by studying literature and legislation. The results of this study conclude that the role of a Notary in legal counseling regarding the practice of buying and selling apartments on a Pre-Project Selling basis can be carried out by ensuring that the developer has complied with statutory provisions and providing an explanation to the buyer that the PPJB is only an introduction. The notary provides an explanation regarding the rights and obligations of each party that arises regarding the practice of Pre Project Selling in buying and selling apartments.
