EL DERECHO A LA VIVIENDA EN ARGENTINA: UNA MIRADA DESDE EL DERECHO ADMINISTRATIVO ESPAÑOL

Abstract

En la Constitución Nacional argentina, el derecho a una vivienda digna y adecuada está previsto expresamente como un derecho subjetivo, judicialmente exigible. En su desarrollo, los distintos niveles de Administración han ido reconociendo, a veces de manera muy amplia, el derecho a la vivienda. Ello ha derivado en la generación de muchos casos judiciales en la materia, en el marco de un sistema de control difuso de constitucionalidad y tanto en acciones individuales como colectivas. Se verá cómo los vaivenes en las reformas legales, pero sobre todo el rumbo político y económico efectivo, que no se ha querido/podido acompasar a las promesas de progresividad en los derechos sociales han sido protagonistas de los principales debates judiciales, y se analizarán las limitaciones de la judicialización para lograr la efectividad real del derecho.Argentinako Konstituzio Nazionalean, etxebizitza duin eta egoki baterako eskubidea espresuki jasota dago, judizialki exijitu daitekeen eskubide subjektibo bat bezala. Konstituzioa garatzean, Administrazioaren maila ezberdinetan aitortu izan da, askotan oso modu zabalean, etxebizitzarako eskubidea. Konstituzionaltasunaren kontrol-sistema lauso baten esparruan, kasu judizial asko eragin ditu horrek, banakako akzioetan zein ekintza kolektiboetan. Ikusiko da lege-erreformen joan-etorriak izan direla eztabaida judizial nagusien protagonistak, baina, batez ere, benetako norabide politikoa eta ekonomikoa, ez delako egokitu gizarte-eskubideei buruzko progresibitate-hitzemateetara, ezin izan delako edo ez delako nahi izan; eta aztertuko da zer judizializazio-mugak dauden eskubide horren benetako eraginkortasuna lortzeko.In the Argentinean constitution, the right to decent and adequate housing is expressly covered as a subjective right judicially enforceable. In its implementation, the several levels of the Administration have acknowledged very broadly the right to housing. That has led to many judicial cases in the matter in the framework of a diffuse system of control of constitutionality and both with individual and collective actions. The ups and downs of the legal reforms will be seen but specially the political and economic course, which has not wanted or been able to adjust itself to the promises of progressiveness of social rights that have been protagonists of the main judicial debates, and the limits of judicialisation will be analyzed with the purpose of achieving the real effectiveness of the right.
