Magistratura e gênero: um olhar sobre as mulheres nas cúpulas do judiciário brasileiro

Abstract

Este artigo explora a questão da ascensão das mulheres na magistratura brasileira a partir do exame da existência de um possível “telhado de vidro”, que limitaria sua chegada de forma representativa à cúpula do judiciário. O estudo realiza uma análise quantitativa da representatividade feminina nas cúpulas da magistratura brasileira tanto na justiça estadual quanto na justiça federal. Os dados compilados foram analisados por segmento funcional. O texto discute, ainda, as principais questões relacionadas à distribuição de gênero no poder judiciário a partir de levantamento bibliográfico e entrevistas com magistradas de tribunais de justiça do Brasil ocupantes de cargos de direção. As principais questões identificadas foram analisadas quanto à construção da heterogeneidade do corpo institucional pela diversidade de gênero e seu impacto na administração das cortes.This study explores the question of the rising of women in the Brazilian Judicial System by testing the hypothesis of the "gender glass ceiling" as a limitation to their actual reaching the top of the judiciary. We perform a quantitative analysis of female representation in the domes of the Brazilian judicial system in two categories: state courts and federal courts. The data collected is analysed by functional segment. The text also addresses key issues related to gender distribution in the judicial system through a literature review and interviews with female magistrates in top positions in Brazilian courts. The main issues identified were analysed from the perspective of the building of gender heterogeneity and its impact on the administration of Brazilian courts.
