Abstract

The purpose of this research is to know how provisions in theological and sociological studies regarding the wife accusing her husband of having an affair and vice versa. Nasab clarity and the protection of someone‟s pride are the main elements in forming order and security in a community. This is what is called the Shari'a the main law that must be maintained. This research is a library study, researchers use qualitative debitor that use the interview method as primary data which then generates descriptive substantive data. Results of this research is the punishments or penalties in the form of whipping or stoning are solely conducted to uphold the shari‟a law principles. Thus, whipping or stoning is not a primary goal or legal objectives. The practices in the time of the Prophet Muhammad Saw. showed this. Therefore, if the punishment or the adultery hadis not applied because the adulterer does not confess and there are not enough four witnesses, the adulterer may be forgiven by Allah for the sins of adultery, and also it could be that Allah will not forgive the adulterer. Allah always gives chance for tobat (repentance) and istighfar (seeking forgiveness). However, if the istighfar is without to batin accordance with the purpose of surah Ali Imran verse 135 and surah An-Nisa‟ verse 17, Allah will not forgive the sins anymore.
