Pour une géographie du droit en action

Abstract

Alors que dans la géographie anglo-saxonne une géographie du droit est en construction, ni les dimensions spatiales et territoriales du droit, ni la place du droit dans les relations des individus à l’espace ne sont problématisées dans la géographie française. À partir d’une réflexion sur les relations entre géographie et droit, dans la première partie, puis de deux parties ancrées sur les conclusions de l’analyse de situations de conflits, qui démontrent l’importance de la dimension cognitive et des processus d’actualisation locale du droit, cet article plaide pour la prise en compte de la dimension juridique de la question normative et pour le développement d’une géographie du droit en action.While legal geography is becoming a recognized branch of geography in the english-speaking world, neither the issue of the spatial and territorial dimensions of law, nor that of the role of law in people’s relationships with space, are raised in french geography. The first part of this article examines the relationship between geography and law, followed by two parts based on the conclusions of an analysis of areas of conflict, which highlight the importance of the cognitive dimension and of the local processes for updating the law. In this way, it puts forward the case for the legal dimension of the normative issue and for the development of legal geography.
