Abstract

It is the subject of this research whether the law lodging can be and how an important tool in the promotion of cultural heritage of an area, be it a country, region or locality receiving tourists. Based on the analysis of the legal systems of Portugal and Brazil on the protection and promotion of cultural heritage, research uses a comparative, functional and systemic methodology for analysis and interpretation of tourist accommodation legislation in both countries in response to the problem research. In short, the question arises whether those essential administrative functions may, by means of that legislation, be adequately met and developed by private agents delocalized in the territory, either for tourist accommodation business. Thus, allows greater readability of the relationship between culture and tourist accommodation in the light of a comprehensive vision of Brazilian and Portuguese legal systems. Analysis of their historical development allows uncover the existence of common regulatory standards in the tourist accommodation legislation in both countries, concluding that there is a Portuguese-Brazilian integrated approach in the valuation function of cultural heritage by the tourist accommodation.
