Abstract

This work aims to examine the enforceability of sustainability in Colombian companies derived from the fiduciary duty of officers and directors, taking into account the duties of diligence, loyalty and good faith. It will be determined whether the inclusion of sustainability analysis is deemed mandatory under the lens of risk management and prudent risk-taking, reaching an affirmative conclusion in respect of the fiduciary duty of diligence.
