Abstract
Sellers who use images resulting from theft of Copyright in the form of images, calligraphy or so on in the media often occur. This study aims to analyse the legal protection of intellectual property of images uploaded to Instagram and find out the sanctions for online sellers who take someone's intellectual property without permission. These problems will be discussed in this study using normative juridical research methods and using secondary data. The results of the study stated that copyright holders of Intellectual Property that have been uploaded to social media are protected both economic rights and moral rights. Legal sanctions for online sellers who violate copyright will get criminal sanctions in the form of fines and imprisonment as stipulated in Article 113 of the Copyright Law. In addition, Instagram as a place for ecommerce also has its own regulations against copyright violators. The results of the study concluded that photos, calligraphy or so on that have been uploaded on Instagram will be protected by copyright but there are still many violations, so there is a need for strict action for violators and increase social media users' knowledge of the importance of protecting copyright.
