Abstract

Wolfgang Kaiser, Spätantike Rechtstexte in agrimensorischen Sammlungen. The article examines a number of heterogeneous, predominantly late antique legal excerpts included in a collection of the Corpus agrimensorum (ms. Vat. pal. lat. 1564). The collection contains authentic legal texts, e.g. CTh. 2, 26 (De finium regundorum), PS 5, 22, 5 and D. 10, 1 (Finium regundorum), forgeries based on authentic constitutions of Theodosius II (Nov. Theod. 4, 20, 24), and an agrimensorial treatise appearing in the guise of an imperial enactment (Fragmentum de monumentis finalibus). The article focuses on questions of textual transmission (including transmission outside the ms. Vat. pal. lat. 1564), textual criticism, and the availability of late antique legal texts (especially imperial legislation) in Italy.
