Função social da empresa

Abstract

Investiga se o princípio da função social da empresa pode atuar como fator limitador ou impeditivo do direito de rescisão do empregador nas dispensas coletivas. Analisa-se a posição da empresa como instituição necessária ao capitalismo e à ordem econômica financeira e social. Em seguida, analisa-se o fenômeno da dispensa coletiva, com o objetivo de compreender seus elementos característicos, sua definição e seus impactos. Conclui-se que o direito potestativo do empregador quanto à dispensa coletiva não é absoluto, limitado pelo princípio vetor da atividade econômica: a função social da empresa, que tem como um de seus pilares o valor social do trabalho.This research aims to investigate whether the principle of the social purpose of a company can serve as a limiting or impeding factor for the employer’s right to terminate employment in collective dismissals. The article analyzes the role of the company as an institution necessary for capitalism and for the economic, financial, and social order. Subsequently, the phenomenon of collective dismissal is examined, with the aim of understanding its core elements, definition, and impacts. The conclusion is that the employer’s potestative right regarding collective dismissal is not absolute, but limited by the guiding principle of economic activity: the social purpose of the company, which includes, among its pillars, the social value of labor.
