Analisis Kriteria Cacat Badan Dan Sakit Sebagai Alasan Poligami Dalam Undang-Undang No.1 Tahun 1974 Tentang Perkawinan Menurut Perspektif Hukum Islam

Abstract

This study aims to determine the criteria for disability and illness as the reason for polygamy in Law No.1 of 1974 concerning Marriage and aims to find out the views of Islamic law regarding the criteria for disability and illness as reasons for polygamy. To find out the answers to the subject matter, the author uses field research methods that are field and supported by library research (library research) through data collection carried out through interviews (interviews) and documentation with informants directly. The results showed that the reasons for the criteria for disability and illness as reasons for polygamy in Law No.1 of 1974 concerning Marriage and in the view of Islamic law were all bodily disabilities and physical or spiritual illnesses that could make the wife unable to carry out her obligations as a wife to her husband , whether it is deformity or pain that is difficult to cure or permanent that cannot be cured. So that polygamy is the best solution for husbands whose wives experience these things.
