Abstract

This article analyses the right to unionize at work within the scope of digital platforms in Brazil. The aim is to discuss the insuffi-ciencies as well as the normative responses provided by the Brazilian law regarding work-related collective conflicts between workers and digital platforms, especially with respect to the protection of unionized activity. The applied methodology was a literature review and empirical case stud-ies, employing investigative data collected from the Public Ministry of Labor as well as that of court cases from the Brazilian Labor Courts. Based on the analysis of violations of the right to unionize carried out by digital platforms, the conclusions reached indicate that there are grave insuf-ficiencies with respect to the protection of the right to unionize in Brazilian legisla-tion, with a set of challenges for the cons-truction of an adequate protective model.
