Pengembangan Hukum Keantariksaan sebagai Suatu Sub Sistem Hukum dalam Sistem Hukum Nasional

Abstract

The national legal system is a legal system in Indonesia that covers all elements of the law from each other interdependent sourced at the preamble of the 1945 Constitution and the legal existence of air and maritime law as a subsystem of the National Legal System, has been conceived and understandably society, because it has been integrated with the long journey constitutional history of Indonesia. In this regard, this study aims to examine the measures and legal action that needs to be done so that the development of the legal system of outer space after the Law No. 21 Year 2013 on Space can develop into sub legal system independent as well as maritime law and the law of the air in the container of the unity of national legal systems. The assessment was conducted by descriptive normative, basing on the view Friedman about the legal system, that in the national legal system should be contained material elements of law (legal subtance), legal structures (legal structure) and the legal culture (legal culture) in relation to the development of the legal system keantariksaan into one whole building in the national legal system, the necessary measures and legal action to be referred to the establishment of the legal system.
