Abstract
The presence of the state is very important for the community during the Covid-19 Pandemic. The state has the authority to realize the welfare state, which is represented by the incumbent who has the right to exercise discretion. This study aims to determine whether vaccination is an individual right or a public obligation. The research method used in writing this article is normative legal research that uses a statutory approach. The results show that everyone has the freedom to make a decision whether they want to have a vaccine or not. However, individual freedom to voice opinions against vaccines can be neglected to protect the lives of many people.
