Abstract

This paper aims to make a distinction between cannabis and other illegal drugs in terms of the way in which the state meets (or does not meet) the conditions required to justify restrictions on individuals' liberty of action. Then, it reviews the growing trend towards legalisation of the cannabis market in several jurisdictions around the world and, finally, as a conclusion, it draws some lessons for a future regulation model that could be useful for Chile.
